Malicious Prosecution - A Police Inspector was accused of having planted Crack Cocaine on a known drug dealer. The jury following a civil trial found that the drugs had been planted and a malicious prosecution against the drug dealer commenced.
Assault - A man was followed by a Police Inspector as he left a police station. He was wrestled to the ground and broke his leg. In order to cover his tracks the police officer alleged that the individual had been abusive towards him and had Breached the Peace. The court however found that the officer had exceeded his duty and assaulted the individual and had unlawfully broken his leg.
Misfeasance from a Public Office - A police firearms unit carried out an arrest on an individual which involved him being arrested at gunpoint by 20 officers. It was later ascertained that the police had wrongly identified the individual involved and had acted upon inappropriate informant information.
False Imprisonment - A child was arrested for an alleged murder and detained for 17 hours before it was realised that the description of the individual did not match the child who had been arrested. The police settled out of court.
In addition to all of the above it will be noted that two members of our executive management team have co-authored a leading text in this area entitled of “Suing the Police; Knowing and Enforcing your Rights”.
Further our CEO has advised that the government’s legal services commission on the minimum standards that should be applied for practitioners seeking to bring actions against the police.
